Terms and Conditions

These Terms and Conditions ("TC") govern the use of the web-based application "Mimori" (the "Service"), a product operated by BearField IT AB (the "Operator"). By using the service, you agree to these TC and our privacy policy. Please read carefully. If you do not agree, you may not use the service.

1. Description of the Service

"Mimori" is a web-based app allowing users to create and manage personalized photo albums for events like weddings or birthdays. Users can create albums, share them via QR codes or links, and allow others to upload photos and videos.

One active free event per account includes 20 assets, 1 GB, and 7 days of access. An eligible active event can be upgraded once for $40 to 100 GB, 14 upload days, and 6 months of access. Stripe processes payments. Mimori activates paid access only after a verified Stripe webhook.

2. Registration and Account Management

Users must register with an email to access certain features of "Mimori." You are responsible for your account security and all activity under your account. Accounts may be suspended or deleted if these TC are violated.

3. Terms of Use

"Mimori" must be used only for lawful purposes. Users are responsible for content shared via their QR codes or links. The operator is not liable for access through links or QR codes intentionally shared by users. Free access ends after 7 days and paid access ends 6 months after activation. Cleanup may complete within 24 hours after access closes. Users are responsible for downloading permitted files before expiry. An administrative refund is unavailable after media is accepted following paid activation.

4. Intellectual Property

All content and trademarks of "Mimori" remain the property of the operator or respective rights holders. Users retain rights to their uploaded content but grant the operator a license to use this content for service provision. Unauthorized copying or distribution of any intellectual property is prohibited.

5. Limitation of Liability

The service is provided "as is" without any warranties. The operator is not liable for direct or indirect damages, including data loss or financial loss. In regions where such limitations are not allowed, they may not apply. Liability is limited to the amount paid for the service.

6. Changes to the Terms

We reserve the right to update these TC at any time. Changes will be communicated by publishing the revised TC. By continuing to use the service, you agree to the updated terms. If you disagree with the changes, you should stop using the service.

7. Termination of Service

We reserve the right to terminate or suspend the service at any time without prior notice. We are not liable for any loss of data or access due to termination. Users will be notified whenever possible and given instructions to secure their data.

8. Applicable Law and Jurisdiction

These TC are governed by the laws of the state where the operator is headquartered. Any disputes will be handled in the courts of that state. If any provision is deemed invalid, the rest of the terms remain in effect.

9. Final Provisions

These TC represent the entire agreement between users and the operator. Changes or exceptions to these terms must be in writing. The operator is entitled to recover legal fees in disputes arising from these TC.
